Profile

Mr. Zhao brings 20 years of litigation experience to his civil practice, with a particular focus on cross-border commercial disputes and contract enforcement matters. Based in Liaoyuan, he has handled over 300 civil litigation cases in the People's Courts, many of which involved foreign parties or matters with international elements that required the application of China's conflict-of-law rules.

His litigation practice covers contract disputes, debt recovery, property disputes, and tort claims. He has particular expertise in disputes arising from international sales contracts, technology licensing agreements, distribution agreements, and construction contracts. Mr. Zhao guides foreign clients through the entire litigation process in China, from pre-litigation demand letters and evidence preservation to case filing, trial, appeal, and enforcement of judgments.

Mr. Zhao is highly experienced in the application of China's Civil Procedure Law, including the specialized rules governing foreign-related civil litigation. He advises on jurisdiction issues, service of process on foreign parties, evidence collection and preservation, and the recognition and enforcement of foreign judgments in China. He has successfully obtained and enforced judgments in cases involving parties from the United States, Germany, Japan, and South Korea.

His practice also includes the recognition and enforcement of foreign arbitral awards under the New York Convention. He has successfully enforced CIETAC, SCC, and ICC awards in Chinese courts, overcoming procedural challenges and substantive objections raised by opposing parties. He also assists foreign clients in the maritime preservation and asset freezing, ensuring that assets are preserved before a judgment is obtained.

Beyond court litigation, Mr. Zhao advises clients on alternative dispute resolution methods, including mediation through the China Council for the Promotion of International Trade and arbitration through CIETAC and the Beijing Arbitration Commission. He has served as counsel in over 50 commercial arbitration cases and regularly consults on the drafting of arbitration clauses in international commercial contracts. He holds an LL.B. from Jilin University and is a member of the Jilin Lawyers Association's Civil Litigation Committee.

Mr. Zhao has broad experience representing foreign clients in construction disputes, property disputes, partnership dissolution, inheritance claims, and personal injury claims. He guides clients through China's court system at the basic people's court, intermediate people's court, and higher people's court levels, as well as the Supreme People's Court for cases of national significance.

His evidence practice includes guiding foreign clients through the rules of civil evidence in China, which differ significantly from common law systems. He assists with evidence preservation procedures, notarization and certification of foreign-origin evidence, and the use of expert witnesses in complex technical cases. He has extensive experience with the Hague Convention on the Taking of Evidence Abroad and the service of process on foreign parties under the Hague Service Convention.

Mr. Zhao also advises on pre-litigation strategy, including the assessment of likely recovery, the identification of assets that can be attached or frozen, and the evaluation of defendants' ability to satisfy judgments. He has developed a network of contacts throughout the Chinese court system that enables him to efficiently manage cases across multiple jurisdictions. He holds an LL.M. in Civil Procedure from Jilin University and has lectured on foreign-related civil litigation at the Jilin Provincial Judges College. He is widely recognized as one of the most experienced civil litigators serving foreign clients in Jilin Province.

Mr. Zhao also advises on pre-litigation strategy, including freezing of assets and evidence preservation. He represents clients in enforcement proceedings, locating and attaching bank accounts, real property, vehicles, and equipment belonging to judgment debtors, ensuring that successful judgments are converted into actual recoveries for his clients.

He has handled the enforcement of multiple foreign judgments and awards in Chinese courts, navigating both the procedural requirements and the substantive defenses that can be raised against enforcement under Chinese law. He is a member of the China Academy of Arbitration Law and the International Bar Association, maintaining a global perspective on dispute resolution that benefits his internationally active clients.

Mr. Zhao also represents foreign clients in the recognition and enforcement of foreign insolvency proceedings in China, a developing area of practice as cross-border insolvencies become more common. He advises foreign insolvency practitioners on the requirements for recognition under Chinese insolvency law and coordinates with PRC courts to protect the assets of foreign insolvent entities located in China.

Mr. Zhao holds an LL.M. in Civil Procedure from Jilin University and has lectured on foreign-related civil litigation at the Jilin Provincial Judges College. He is admitted to practice law in the People's Republic of China and serves on the Civil Litigation Committee of the Jilin Lawyers Association. He is a member of the China Academy of Arbitration Law.

Mr. Zhao has advised several international clients on the recognition and enforcement of foreign judgments in China, a procedurally complex area that requires careful navigation of China's civil procedure rules and the principle of reciprocity. He has represented clients in cases involving recognition of judgments from courts in the United States, the United Kingdom, Germany, Singapore, and South Korea, developing a thorough understanding of how Chinese courts apply the reciprocity requirement in practice.
