Workplace Injury Compensation in China: What Expatriate Workers and Foreign Employers Must Know
Workplace injuries are a significant concern for foreign employers operating in China and for expatriate workers employed by Chinese companies. Understanding the work-related injury insurance system is essential for both compliance and compensation.
Work-Related Injury Certification
Under China's Social Insurance Law and the Regulations on Work-Related Injury Insurance, an injury is compensable if it arises out of and in the course of employment. This includes injuries during working hours at the workplace, work-related travel, commuting accidents under certain conditions, and occupational diseases listed in the national catalog.
- ⚖️ Certification Application The employer must apply to the local Human Resources and Social Security Bureau within 30 days of the injury. If the employer fails to apply, the employee or their family may apply within one year.
- 📋 Disability Grade Assessment After certification, a medical evaluation determines the disability grade (1 to 10, where Grade 1 is most severe). This grade determines the compensation amount.
- 💰 Compensation Package Includes medical treatment expenses, one-time disability subsidies (7-27 months wages depending on grade), monthly disability allowance (for Grades 1-4), and death benefits.
Employer Obligations and Insurance
Employers must enroll all employees in work-related injury insurance. The premium rate varies by industry (0.2%-1.9% of total payroll). Uninsured employers bear the full cost of compensation and face administrative penalties of up to RMB 10,000 plus interest on unpaid insurance premiums.
Jiangxi Province applies specific compensation multipliers based on the local average wage. For 2025, disability severance payments range from 7 times the monthly wage (Grade 10) to 27 times the monthly wage (Grade 1).
Third-Party Claims
When a workplace injury is caused by a third party, the injured worker may pursue claims against both the insurance fund and the third-party tortfeasor. Medical expenses cannot be recovered from both sources, but disability subsidies and other benefits may be cumulative.
Special Considerations for Expatriates
Foreign workers holding valid work permits and residence permits in China are entitled to work-related injury insurance coverage on the same basis as Chinese employees.
